Village Board Minutes September 23, 2008

Minutes of the Village Board meeting held at the Highland Mills Firehouse, 455 Route 32, Highland Mills,

New York on September 23, 2008 at 7:40PM

Present: Stephanie Berean-Weeks, Mayor

Neil Crouse, Richard Mackson and Patrick Kinney, Trustee

Absent: Moann Stabile, Trustee

Also Present: Kelly Naughton, Attorney for the VillageQ Gary Thomasberger, Building InspectorQ

Dominick Prozzillo, Fire ChiefQ Maria Hunter and Lorraine McNeill, Planning Board

I. Public Hearing:

a. Outdoor Public Assembly :

A public hearing was held to entertain comments on the adoption of a new Chapter 243 of the

Village Code entitled YPublic Assembly, OutdoorZ. The public notice was printed in the Times Herald

Record on September 16, 2008 and the following comments were received:

Maria Hunter cited several areas of the proposed law that she felt needed to be reworded,

expanded or were unnecessary. Some of the areas addressed were as follows:

1. 243-3(2) requires an application to be submitted sixty days prior to the event and she

feels that most events are not planned that far in advanced. Inspector Thomasberger

stated the requirement is there for applications that must go before the Planning Board.

Mrs. Hunter suggested that a second deadline be established for the smaller gatherings.

2. 243-3(3)(a) requests the applicant to provide their age when applying for the permit.

She feels this is discriminatory.

3. 243-3(4) requires that a number of different agencies be contacted by the applicant.

She feels most are unnecessary (citing Orange County Department of Health and New

>ork State Department of Health). She feels that if the local agency feels another should

be contacted, they should be the entity to do so. Inspector Thomasberger noted this

section states Yas deemed applicable by the permitting authorityZ so he feels nothing

should be changed just in case those agencies become required.

4. 243-3(7) lists events exempt from the law and she feels West Point should be included

as well as the Woodbury Ambulance and both Fire Companies. She also feels that only

school related events should be exempt and not school sanctioned events.

5. 243-3(9)(c) states the permit will expire at the end of the event. She noted that some

entities may have events weekly and suggested a clause be added that would require

them to obtain one permit for these type events and have it expire at the end of the

calendar year.

Chief Prozzillo stated he agrees that the age of the applicant should be required so that

teenagers are not applying for applications to have events that they may not be authorized to do.

Frank Collins stated the Woodbury Common has events that are held at their gazebo (concerts,

bands, etc) and asked if they would be required to obtain a permit. Trustee Crouse stated they would if

the sole purpose of those there were to watch the performance.

Kevin Abrams asked who would be responsible for paying the consultant fees when an

application is required to appear before the Planning Board. Inspector Thomasberger stated the law

requires that an escrow account be established by the applicant and the fees would be paid from that

designated account, similar to all other applications that appear before the Planning Board. Mr. Abrams

then stated funerals should be listed as an exemption.

Chris Scibelli stated he feels this law is another attempt in the Village becoming unfriendly and

acting unfairly to businesses.

Trustee Crouse noted two corrections to the law. Section 243-3(1) should state Planning or

Village Boards. Section 243-3(11), last line, should have the YorZ removed from between YentitiesZ and

YassociationsZ.

With no further comments received, a motion was offered by Trustee Kinney, seconded by

Trustee Mackson, to close the public hearing.

II. Administrative Business:

a. Acceptance of Minutes:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Crouse, to accept the

minutes of the meeting held September 10, 2008.

b. Approval of Abstract:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Crouse, to approve Abstract

8, Vouchers e20080473 - e20080561, totaling f282,093.35.

c. Fire Department Equipment Requests:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Kinney, to approve Fire

Department Equipment Requisition 2008-15 totaling $11,965.03 for the purchase of six sets of NFPA

firefighting gear.

Motion was then offered by Trustee Kinney, seconded by Trustee Mackson, to approve Fire

Department Equipment Requisition 2008-16 totaling f2,470.10 for the purchase of various pieces

equipment for the brush truck. It was noted that the Department of Environmental Conservation has

awarded the Fire Department a matching grant for this equipment, up to f1000. All equipment must be

purchased by October 8 and they will inspect the pieces prior to a check being sent to the Village for

reimbursement.

EXTRA ITEM h Use of Building Request:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Mackson, to approve the

request received by Woodbury Boy Scout Troop 149 to use the meeting room on October 16, 6PM h

9PM, for the purpose of conducting a YCourt of HonorZ ceremony.

III. Old Business:

a. Adoption of Employee Handbook/Manual:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Kinney, to adopt the

Employee Handbook/Manual for the Village of Woodbury.

b. Liquor License Application/Renewal Notifications:

Mayor Berean-Weeks stated verbal notification was received from Chief Kwiatkowski this

afternoon stating there is no objection to Kristyks Bar and Grill and Uno Chicago Grill from

applying/renewing their liquor license. Clerk Potvin was directed to send a letter to the liquor authority

noting no objections to the applications.

c. Update h Proposals for Seal Coating of Parking Lot:

Trustee Mackson stated he gave a draft copy of the proposal sheet to Attorney Naughton this

evening and he hopes to have proposals to discuss at the next meeting.

d. Update h Proposals for Painting of Indoors:

Mayor Berean-Weeks stated Chief Prozzilo was able to obtain two written quotes, as required

by the Procurement Policy, for the painting of the walls inside the firehouse, upstairs and downstairs.

The quotes received were as follows: Dan Derek Painting f6,140 and Precise Painting and Wall Covering

f4,800. A motion was offered by Trustee Crouse, seconded by Mayor Berean-Weeks, to award the

project to Precise Painting and Wall Covering at a cost of f4,800. Clerk Potvin will contact them to make

arrangements with Chief Prozzillo so access can be granted downstairs.

IV. New Business:

EgTRA ITEM h Speed Limit/Traffic on Dunderberg Road:

A letter was received from the principal of the High School requesting the Board to consider

reducing the speed limit on Dunderberg Road running in front of the High School and Middle School

from 30MPH to 20MPH. The letter also addressed the increased traffic in front of the schools.

Attorney Naughton stated the Village has the authority to do this but the County has been contacted for

their comments. Mayor Berean-Weeks stated this issue will be discussed further at the next meeting. A

discussion was then held regarding the traffic light at the entrance to the High School.

EXTRA ITEM h Repairs to Circulator Pump:

Mayor Berean-Weeks stated one of the three circulator pumps for the building is in need of

repair. Clerk Potvin was asked to contact three companies to obtain written quotes for the repairs to be

considered at the next meeting.

EgTRA ITEM h Specification for Fire Department Utility Vehicle:

Attorney Golden has submitted a draft of the specifications for the purchase of a utility vehicle

for the Fire Department. Chief Prozzillo will review the specifications and, upon his approving them, the

Board will authorize advertising for bids at the next meeting.

V. Board Member/Department Comments:

Trustee Crouse stated the first meeting of the sign committee was held last evening and it was

very productive.

Mayor Berean-Weeks reminded the Board and public that there is a special worksession

scheduled for September 25 at 6PM for the Board to begin reviewing the draft comprehensive plan.

Chief Prozzillo informed the Board that the Fire Department is in the process of revising their bylaws.

There were no public comments.

With no further comments received or business to discuss, a motion was offered by Mayor

Berean-Weeks, seconded by Trustee Mackson, to adjourn the meeting at 8:35PM.
