Minutes of the Village Board meeting held at the Highland Mills Firehouse, 455 Route 32, Highland Mills,
New Fork on September 10, 2008 at 7:30PM

I. Public Hearing:
a. Street Requirements and Specifications:
A public hearing was held to entertain public comments on Introductory Local Law \8 of 2008 to
amend Section 269-27 entitled ^Street Requirements and Specifications_ to provide for the
thermoplastic stop lines at all stop signs on newly dedicated streets. The public notice was printed in
the Times Herald Record on September 3, 2008 and no comments were received.
Motion was then offered by Trustee Crouse, seconded by Trustee Oackson, to close the public
hearing.

Motion was then offered by Mayor Berean-Weeks, seconded by Trustee Crouse, to declare the
Village Board as Lead Agency for this action.

Motion was then offered by Mayor Berean-Weeks, seconded by Trustee Oackson, to adopt Local
Law 7 of 2008 as follows:
A Local Law amending Section 269-27 of the Code of the Village of Woodbury entitled ^STREET
REQUIREMENTS AND SPECIFICATIONS_ to provide for thermoplastic stop lines at all stop signs on newly
dedicated streets.
BE IT ENACTED by the Village Board of the Village of Woodbury, Orange County, New Fork as
follows:
SECTION 1: PURPOSE.
The purpose of this Local Law is to regulate the quality of streets and roads accepted for
dedication by the Village. Specifically, in order to provide for a safer traveling way for Village residents
and other members of the public the Village desires to require the addition of stop lines whenever and
wherever a ^STOP_ sign is located for all roads and streets offered for dedication on and after the
effective date of this law.
SECTION 2: AMENDMENT.

Section 269-27(B)(3)(e) of the Code of the Village of Woodbury is hereby repealed and the
following language substituted in its place:
^(e) Intersections. Street intersections shall be as nearly at right angles as possible,
and in no case shall they be less than 60g. No more than two streets shall meet or
intersect at any one point and the center lines of both intersecting streets shall pass
through a common point. Sight distances shall comply with ITE recommendations for
the type of traffic control at the intersection. Wherever a ^STOP_ sign control is
installed at an intersection or other location as directed by the Village Board of Trustees
on the recommendation of the Highway Superintendent, Village Engineer or Police
Department, the intersection or other location shall have ^STOP_ signs posted and
thermoplastic stop lines installed in accordance with the Manual on Uniform Traffic
Control Devices and complying with the latest material standards of the Highway
Department._
SECTION 3: SAVINGS CLAUSE.
If any clause, sentence, paragraph, section or part of this local law shall be adjudged by any
court of competent jurisdiction to be invalid, such judgment shall be confined in its operation to the
clause, paragraph, section or part thereof directly involved in the controversy in which such judgment
shall have been rendered.
SECTION 4: SUPERSEDING PROVISION.
To the extent that any State or local laws fail to provide specific authority for this Local Law, or
otherwise appear to be in conflict with this Local Law, then such laws are hereby superseded by this
Local Law pursuant to New Fork Municipal Home Rule Law and the common law, including, but not
limited to Article 6 of the New Fork State Village Law.
SECTION 5: EFFECTIVE DATE.
This Local Law shall take effect immediately upon the filing of this Local Law with the New Fork
Secretary of State in the manner provided for in the Municipal Home Rule Law.

Motion was offered by Trustee Crouse, seconded by Trustee Oackson, to accept the minutes of
the meeting held August 26, 2008.

c. Use of Building Request:
Motion was offered by Trustee Crouse, seconded by Trustee Oackson, to approve the request
received by the Highland Mills Post Office to use the meeting room on October 2, 2008 from 10AM k
2PM and to waive the rental fee.

ElTRA ITEM k Fire Department Equipment Request 2008-014:
Motion was offered by Trustee Oackson, seconded by Trustee Crouse, to approve Fire
Department Equipment Requisition 2008-014 for the purchase of 85 Minitor V nylon carrying cases at a
cost of j10 each.

III. Old Business:
a. Discussion/Appointment k Sign Committee:
Only one letter was received from the public (Oohn Kelemen) volunteering to serve on the sign
committee. Trustee Crouse stated he feels that, since Mr. Kelemen is a business owner in the Village
and spoke against the law, as well as insulted the Building Inspector at the public hearing, he has
concerns about him serving on the committee. Mayor Berean-Weeks stated Frank Collins, who is the
designated member of the Chamber of Commerce to serve on the committee, is also a business owner
and spoke against the law at the public hearing in a disrespectful manner to the Board. Trustee Oackson
added that he took Mr Kelemenms comments made at the public hearing as insulting the
language/contents of the proposed law and not the intelligence of the Building Inspector. Sandra
Capriglione asked what the purpose of the committee is. Attorney Naughton stated the purpose is to
review the proposed law as written and suggest edits to the Village Board to consider. Robin Crouse
stated she does not believe that another business owner should be sitting on the committee. Trustee
Crouse added that the County had reviewed the proposed law pursuant to GML 239 and suggested its
adoption as is, though they did note some areas of caution. Motion was then offered by Mayor Berean-
Weeks, seconded by Trustee Crouse, to create and appoint the following individuals to serve on a
committee to review the proposed sign ordinance: Trustee Crouse (Chair), Trustee Kinney, Building
Inspector Thomasberger, Planning Board member Thomas Bompensiero, Zoning Board member Sandra
Capriglione, Chamber of Commerce representative Frank Collins and member of the public Oohn
Kelemen.

b. Adoption of Plan k Workplace Violence:
Motion was offered by Mayor Berean-Weeks, seconded by Trustee Oackson, to adopt the
^Workplace Violence Prevention Program_ as prepared by Public Sector HR Consultants LLC.

c. Update k Outdoor Maintenance Proposals:
Mayor Berean-Weeks stated this item will be tabled since Trustee Stabile is not present to
provide an update.

d. Update k Sealing of Parking Lot Proposals:
Trustee Oackson stated he is still working on drafting the proposal form for Attorney Golden to
review prior to him soliciting businesses. He will have an update for the next meeting.
e. Update k Indoor Painting of Building Proposals:
Mayor Berean-Weeks stated only one written proposal was received and an attempt to get
more will be made for discussion at the next meeting.
f. Discussion/Review k Employee Handbook:
The Board continued and finished the review the employee handbook. Clerk Potvin will make
the edits discussed and prepare a final document for adoption at the next meeting.
ElTRA ITEM k Codebook Proposal:
Motion was offered by Trustee Crouse, seconded by Trustee Oackson, to authorize the Mayor to
sign the contract with General Code Publishers to prepare and print the Codebook for the Village of
Woodbury at a cost of j9,675.

IV. New Business:
ElTRA ITEM k Liquor License Renewals:
Clerk Potvin stated she received notification from Uno Chicago Grill of their intentions to renew
their liquor license and Kristyms Bar and Grill of their intention to apply for a liquor license. Both letters
were received on September 9, 2008. She has forward the information to the Police Department and
requested a response for the next meeting.
V. Board Member/Department Comment:
Trustee Crouse reported that there are lights on the side of the building that needs to be
replaced. The two lights in the back of the building are out as well. Mayor Berean-Weeks stated she
believes Chief Prozzillo was ordering the parts needed to replace the lights. Trustee Crouse then stated
he has heard conflicting stories regarding a block party that occurred on Laura Lane last month. Chief
Kwiatkowski stated he has attended the meeting this evening to correct the information that the Board
may have received. He noted the following true events: (1) there is no litigation pending before his
department regarding the block party (2) one of his patrol cars were damaged by participants at the
block party, but not seriously (3) property was stolen from one of the patrol cars and (4) outside
agencies were called upon to aide his department at the block party. He feels the Board needs to
establish a policy, in addition to the proposed outdoor public assembly law, regarding block parties. He
suggested that the Police Department submit input to the Board (similar to how liquor licenses are
handled) prior to approval being granted. He also feels that a majority of the residents of the street
should sign a petition requesting the block party and not just one individual. The requestors must live
on the street as well. He added that they should also be reminded that open alcoholic containers are
not permitted on Village roads. The Board agreed with these recommendations and Clerk Potvin will
send a letter to all block party applicants on file informing them of the procedure to be followed as well
as the outdoor public assembly law, once it is adopted. Superintendent Stabile added that, if the
residents decide to cancel their parties they need to notify him so he does not waste time and money
cleaning their street.

Superintendent Stabile stated Larkin Drive is ready for its final blacktop coat and will then be
offered for dedication (Melody Lane to the Village boundary next to Monroe k Melody Lane to Route 32
is currently maintained by his department). The traffic light will then become the responsibility of the
Villages however there is an agreement that requires the property owners to maintain it. Clerk Potvin
stated an escrow account should be established to be used in case the mall owners fail to do so.
Superintendent Stabile stated there is a meeting scheduled for tomorrow afternoon with Engineer
Lindsay and mall management to discuss all the outstanding issues prior to dedication being offered.
VI. Public Comment:
Dick Manley asked when the worksession to review the Comprehensive Plan was scheduled for
and he was told September 25.
VII. Adjournment:
With no further comments received or business to discuss, a motion was offered by Trustee
Crouse, seconded by Trustee Oackson, to adjourn the meeting at 8:50PM.
