Minutes of the Village Board meeting held at the Highland Mills Firehouse, 455 Route 32, Highland Mills,

New York on October 28, 2008 at 7:30PM

Present: Stephanie Berean-Weeks, Mayor

I. Administrative Business:

a. Acceptance of Minutes:

Motion was offered by Trustee Stabile, seconded by Trustee Crouse, to accept the minutes of

the October 14, 2008 meeting.

b. Approval of Abstract:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Stabile, to approve Abstract

c. Request to Use the Building:

This item was tabled to the next meeting due to lack of quorum (the request was made by

EeTRA ITEM g Change of Village General Election Day:

Motion was offered by Trustee Crouse, seconded by Trustee Stabile, to adopt the following

resolution:

WHEREAS, Section 15-104(a) of the Election Law provides that Villages with elections held in

March of each year be held on the third Tuesday in MarchS and

WHEREAS, Section 15-104(b) states that when the third Tuesday of March falls on the 17th (St

Patrickhs Day), the Village Board of Trustees is required to adopt a resolution providing that the election

will be held on March 18.

NOW, THEREFORE, BE IT

RESOLVED, that the Village Board of the Village of Woodbury does hereby change its General

Election date from March 17, 2008 to March 18, 2008, pursuant to Section 15-104(b) of the Election

Law.

II. Old Business:

a. Update g Outdoor Maintenance Proposals:

Trustee Stabile stated she is having difficulties finding a company that carries the insurance

requirements suggested by the Villagehs insurance agent. Attorney Golden suggested Marshall i

Sterling be contacted to discuss their recommendation. Trustee Stabile stated she would contact them.

b. Update g Seal Coating of Parking Lot:

Highway Superintendent Stabile submitted a proposal to the Board for jquick set slurryk of the

parking lot and driveway. The proposal had two prices quoted (both from State bid). The price of

`16,788.08 is if the Village wants to have the work done now and the price of `12,420 is if the Village

waits until the Town resumes their road maintenance program in the Spring/Summer. He informed the

Board that this type of work would last several years as opposed to sealing the lot, which is done more

frequently. Mayor Berean-Weeks thanked Superintendent Stabile for the information and the issue

would be discussed again at budget time.

c. Update g Repair of Circulating Pumps:

Mayor Berean-Weeks stated she authorized the circulator pumps by A-Star since the situation

became one of emergency. Three businesses were contacted for quotes and none were received. The

temperature in the office/meeting room was 55m and lower. Two of the pumps have been sent out to

be repaired/rebuilt and the unit is currently working on three units.

d. Discussion g Reduction of Speed Limit on Dunderberg Road:

Attorney Golden stated no correspondence has been received as of yet from the State or the

County. He stated that he believes the law permits the Village to act on this without State approval

(citing Sections 16-22 and 16-43 of the Vehicle and Traffic Law). It was decided that a measurement will

be made to determine exactly where the reduced speed limit would begin and end. A resolution would

then be prepared and discussed at the next meeting.

e. VOTE g Outdoor Public Assembly Local Law:

Motion was offered by Mayor Berean-Weeks, seconded by Trustee Crouse, to declare the

Village Board of the Village of Woodbury as Lead Agency for the adoption of a local law entitled jPublic

Assembly, Outdoork.

Motion was then offered by Trustee Crouse, seconded by Mayor Berean-Weeks, to type this

action as an unlisted one.

Motion was then offered by Mayor Berean-Weeks, seconded by Trustee Crouse, to determine

the significance of this local law as having a negative declaration based on the Environmental

Assessment Form that was completed.

Motion was then offered by Mayor Berean-Weeks, seconded by Trustee Crouse, to adopt Local

Law ]8 of 2008 enacting a new chapter of the Code of the Village of Woodbury providing for Chapter

243 entitled jPublic Assembly, Outdoork.

Trustee Stabile did not state why she voted no. Clerk Potvin asked Attorney Golden what happens next.

Attorney Golden stated the Board can choose to revote at a future meeting, rewrite the law and have

another public hearing or the entire topic is closed.

III. New Business:

a. Discussion g Proposed Equity Indexed Group Annuity Contract:

A proposal was received from VFIS announcing the offer of a jEquity Indexed Group Annuity

Contractk issued by Hartford Life Insurance Company (this is for the LOSAP program g Firemen Service

Awards). Since the Board members present were unsure as to what exactly was being proposed, Clerk

Potvin was asked to contact former Trustee Michael Kling and request that he review the proposal.

Attorney Golden will review as well.

b. Discussion g Seasonal Dwellings:

Mayor Berean-Weeks stated the last time the Board discussed this issue was in February. She

would like a local law drafted for the Board to consider. She asked that Attorney Golden, Engineer

Lindsay, Planner Turner and Building Inspector Thomasberger prepare a draft for recommendation to

the Board.

c. Proposal g Repairs to Air Conditioning Units:

A proposal was received from A-Star to re-insulate the split air conditioning units on the roof. It

was determined, during their regular maintenance preformed on October 2, that the existing insulation

was missing and torn. The quote received was `662.80. Pursuant to the procurement policy, any work

under `4,000 requires two verbal quotes.

EeTRA ITEM g Lighting in the Firehouse:

Clerk Potvin was asked by Chief Prozzillo to inform the Board that there are 32 florescent bulbs

out in the truck bay. There are also three rooms (work room and two storage rooms) that still have the

motion censored lights. These lights are not working properly and he suggests they be converted to

switches like the rest of the building. Motion was offered by Trustee Stabile, seconded by Trustee

Crouse, to authorize Chief Prozzillo to purchase the florescent bulbs for the truck bay and hardware

needed to change the light switches in the work room and two storage rooms.

IV. Board Member/Department Comments:

Mayor Berean-Weeks stated Route 32 will be dug-up and repaved beginning November 3. The

work is expected to last three weeks. She then reminded the public that there is a curfew in effect for

Halloween.

Superintendent Stabile noted that Larkin Drive has been blacktopped but he feels that the offer

of dedication will be done some time next year.

County Legislator Donnery stated she and Legislators Fonario and Townsend wrote a letter to

County Executive Diana regarding the County Route 44 violations that have occurred in the Village of

Kiryas Noel. There have also been letters written by the leaders of the surrounding communities and she

urged Mayor Berean-Weeks to send a letter as well. Trustee Crouse asked Attorney Golden to draft a

letter for the Village Board to sign and send to County Executive Diana.

V. Public Comment:

Elaine Osterhout stated she lives directly across from the Woodbury Nunction development on

Summit AvenueS the tributary of Woodbury Creek separates her property from the development. She

has a well that for the past 23 years has been fine. Over the past year, her water quality has

deteriorated to the point where she now cannot use her shower, washing machine or dishwasher. Her

family and she must use bottled water to drink, cook and brush their teeth. The water is polluted with

high levels of e-coli and she feels it is due to the water run-off from Woodbury Nunction. Trustee Stabile

asked why this property is not in the Consolidated Water District. Superintendent McClennan stated the

district boundaries end before Mrs. Osterhouths property. Attorney Golden stated there are steps that

the Village Board can follow if they choose to extend the district lines to include this property. Mayor

Berean-Weeks asked the estimate cost of extending the pipes. Superintendent McClennan stated the

cost would be approximately `100 a foot and several hundred feet of piping would need to be laid,

usually at the ownerhs expense.

VI. Adjournment:

With no further business to discuss or comments received, a motion was offered by Mayor

Berean-Weeks, seconded by Trustee Stabile, to adjourn the meeting at 8:45PM.
