WHEREAS, the Village of Woodbury Board of Trustees adopted Local Law 4 of2007 at its November 27, 2007 meeting amending Chapter 143 of the Code of the Village of Woodbury to provide for the changing of fees by resolution rather than 10ca1law; and WHEREAS, at its January 8, 2008 meeting the Board of Trustees increased the cost of construction fees to $100.00 per square foot of living area; and

WHEREAS, the Board of Trustees desires to grandfather those subdivision, site plan and special permit applications that had received fmal approval from the Planning Board from the fee increase.

NOW, THEREFORE, BE IT RESOLVED that the Village of Woodbury Board of Trustees hereby grandfathers those subdivision, site plan and special permit applications having received Final Approval from the Woodbury Planning Board prior to January 8, 2008 from the new fee schedule and their fees shall remain those fees in effect prior to the increase on January 8, 2008 until May 31, 2009.

b. Outdoor Property Maintenance:

Trustee Stabile stated Clerk Potvin mailed a proposal sheet to all three businesses that submitted quotes and only one was returned. She is appalled by the quote for snow removal and would like to solicit more quotes. Clerk Potvin stated Mayor Berean-Weeks requested that the snow removal be added to the bid in case the Town decides to no longer remove the snow for the Village. It was decided the proposal would be rewritten to list the snow removal as an "option" and Clerk Potvin will resend the form to the entities that previously submitted proposals. Deputy Mayor Stabile will also send the form out to other entities to obtain a larger amount of responses.

c. Discussion - Repair of Sound System:

Deputy Mayor Stabile stated there is nothing wrong with the equipment owned by the Village. It appears that the receiver that is owned by the HM Fire Company and used to transmit over the speakers is damaged (half of it is "burned out''). A new amplifier will cost approximately $400. This issue was discussed and several ideas were suggested. It was decided that Deputy Mayor Stabile would purchase an enclosed cabinet, on wheels, that would house the audio/visual equipment and it would be stored in the office.

d. Adoption of Local Law - Codebook:

After Attorney Golden informed the public of the process, to date, that the Board has followed regarding the adoption of their official Codebook, a motion was offered by Deputy Mayor Stabile, seconded by Trustee Jackson, to adopt Local Law 6 of2008 as follows:

Section 1. (Please see attached) **

** Extensive revisions throughout the entire Code were made and, due to its size, it would be burdensome to include in the minutes. A fully printed copy of the law as adopted isjiled in the office of the Village.

Section 2. Savings Clause.

If any clause, sentence, paragraph, section or part of this 10ca1law shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall be confined in its operation to the clause, paragraph, section or part thereof directly involved in the controversy in which such

b. Acceptance of Bids ~ Manhole & Rehabilitation Phase I:

Clerk Potvin stated a bid opening was held on July 9, 2008 and the following proposals were received for the project known as "Sanitary Manhole and Sewer Rehabilitation Phase I" through the Infiltration and Inflow capital project:

Green Mountain Pipeline Services, Slingerlands, NY $313,899.00
Lash Contracting, Latham, NY $272,800.00

Engineer Lindsay explained the purpose of the project to the Board in detail. A motion was then offered by Deputy Mayor Stabile, seconded by Trustee Kinney, to accept the bid received from Lash Contracting in the amount of $272,800 for the "Sanitary Manhole and Sewer Rehabilitation Phase I" project, subject to waiting periods established by NYS Law regarding bonding and permissive referendums.

c. Acceptance of Bids - Pan & Tilt Camera Inspection System:

Clerk Potvin stated a bid opening was held on July 9, 2008 and the following proposals were received for the purchase of a pan and tilt miniature camera inspection system (in connection with the Infiltration and Inflow capital project):

EnviroQuip Inc., Brewster, NY MANUAL $49,777.80
AUTOMATIC $59,595.00
Aries Industries, Wakesha, WI MANUAL $47,713.00

(less $3066 if declining inclinometer) Engineer Lindsay explained the need for the camera and the difference between the manual and automatic options. He stressed it would be a financial benefit to the Village to purchase the automatic option rather than the manual. Attorney Golden stated that, although only one bid was received for an automatic option camera, the Village did follow due diligence to obtain responsible and responsive bids for this purchase. A motion was then offered by Trustee Crouse, seconded by Trustee Jackson, to purchase the automatic pan and tilt miniature camera inspection system from EnviroQuip Inc., in the amount of $59,595, subject to the waiting periods established by NYS regarding bonding and permissive referendums.

d. Approve Request to Temporary Close Road:

Motion was offered by Trustee Crouse, seconded by Trustee Kinney, to approve the request to temporarily close Laura Lane on August 23,2008 from Noon until Midnight for the purpose of residents of that street to hold a block party. It was noted that the approval is granted with the condition that no parking will be permitted on V alley Avenue or the other surrounding streets. Deputy Mayor Stabile will contact the Police Chief to request that temporary no parking signs be erected.

Planner Turner stated the Comprehensive Plan Committee has completed the Comprehensive Plan and submitted it to the Village Board for their consideration and action. He has received telephone calls asking for the Village Boards schedule regarding this issue. Trustee Kinney stated he agrees the Village needs to determine a schedule so the Comprehensive Plan can be finalized and adopted. This will be discussed at the August 26 meeting.

Highway Superintendent Stabile informed the Board that County Route 44 will be closed for thirty days beginning August 25, 2008 from Ridge Road to Bakertown Road. He then requested that the old truck used by the Building Department be donated to the Town for use by Refuse Clerk Sheila Beadle. A motion was offered by Trustee Crouse, seconded by Trustee Kinney, to transfer the vehicle formerly used by the Building Department to the Town, at no cost, subject to their acceptance.

Superintendent Stabile then stated that, during the Brigadoon meeting mentioned earlier this evening, he requested stop lines be painted on the road with the stop signs erected. He was told that they are not legally required. Attorney Golden stated there is nothing the in Vehicle and Traffic Law that requires stop lines be painted with stop signs. It was not part of the Planning Board resolution either but the Board can make it a condition of the acceptance of roads if it so chooses. If that is the case, the Board should let the developer know prior to the paperwork being filed. A discussion was held resulting in a motion being offered by Trustee Kinney, seconded by Trustee Crouse, to require that all stop lines be painted, in connection with the stop signs erected, on all roads that are offered for dedication to the Village. The Board would like the Planning Board to consider adding this request to all future resolutions adopted by them.

V. Public Comment:

Tom Sullivan stated the parking of vehicles on both sides of Adams/Hunter Street (when a ball game is occurring in Brickley Field) has caused some serious traffic issues. He is afraid thatthe children that run across the street will be hit and suggested signs be erected permitting parking only on one side of the street. Regarding the traffic light for County Route 105, he feels that traffic could be reduced if a delayed green or turn signal were used so people could make a left onto Country Route 105. Superintendent Stabile stated this is a State issue and he has been

. informed they-are reviewing it. Mr. Sullivan then asked if the manhole covers on the newly paved roads in Skyline will be raised. Superintendent Stabile stated they would not be for the following reasons: (I) when the temperature decrease, they raise and could be hit by the plow trucks and (2) they are cheaper then speed bumps.
